Man With Terminal Illness Evicted For Medical Marijuana Use

A terminally ill man is facing eviction and may spend his remaining days homeless for smoking medical marijuana perscribed by his doctor. The housing complex where he has lived for 17 years wants to evict him because of the drugs he uses for his terminal illness.

He calls medicinal marijuana a necessity, but regardless of that fact that the marijuana is legal in his state, and was prescribed by his doctor, the housing complex says he is no longer welcome.
He recently received a letter from his housing manager saying he's kicked out of his home for "drug-related criminal activity," referring to his use of marijuana.

"When she gave me the notice, I even told her, I don't even have any plants. So ya'll just evicting me because I'm on medical marijuana," he asked.

While medicinal marijuana is legal in the state of Nevada, the regional housing authority says when they interpret the law, they go by what the federal government says.

"Our policy is zero-tolerance for drugs of any kind irrespective on whether or not they are licensed to use medical marijuana," says Carl Rowe with the Southern Nevada Regional Housing Authority.



The story is being reported by ABC Action 13 News in Las Vegas.

  14. I live in HUD senior housing in San Diego, California. My state has legalized medical marijuana and may soon legalize all marijuana. But according to HUD regulations, I could still be evicted for using marijuana, so I can only hope that I never get glaucoma, cancer, or any of the other illnesses for which marijuana is a recommended treatment. My federal government has no concern for human welfare unless it profits big corporations.

  20. I am familiar with this complex and it as State onwed property. I;m not sure how they are applying Federal law. I beleive this issue is more of and Black & White issue.

  22. Well first of all, Nevada has a crazy medical marijuana conondrum going on right now. It is legal to smoke medical marijuana in the State provided you have a perscription, It is legal to posess medical marijuana in the State provided you have a prescription, but you can not buy it and it cannot be sold.
